Terms of service

Last updated October 31, 2026

These terms are an agreement between you and Nextgen AI Solutions (Pty) Ltd (registration number 2025/167932/07, South Africa) ("we", "us"), the provider of Utopia. By creating an account or using Utopia, you agree to them. Please read them together with our privacy policy and refund policy.

1. What Utopia is

Utopia is AI-powered journaling, goal-setting and mindset software. You answer questions about what matters to you, and Utopia uses AI to write and narrate a personal manifesto, suggest small daily actions, and offer a journal and an AI coach. Narration is read by AI-generated voices, not by people. If you choose own voice, your manifesto is read by an AI voice made from your own recordings.

Utopia is not therapy or professional advice. It doesn't give medical, psychological, financial, legal or other professional advice, and it doesn't predict the future or promise any result. The ritual calendar uses the dates of the new and full moon only as a rhythm for reflection; it makes no claim that the moon affects you, and it offers no readings, signs or predictions. Content is generated by AI and may be inaccurate or unsuitable for your situation; use your own judgement. The breathing exercises in Utopia Exhale are for relaxation only. Breathe gently, stop if you feel unwell, and check with a doctor first if you have a health condition or are pregnant. If you are in crisis or may be at risk of harm, contact your local emergency services or a crisis line straight away.

2. Who can use Utopia

You must be at least 18 years old. You're responsible for keeping your sign-in details secure and for activity in your account.

3. Orders and payment

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Paddle's own buyer terms also apply to your purchase.

4. Plans, free trial and renewal

  • Utopia has a free plan and a paid plan, Premium, billed monthly or yearly. Current prices are on our pricing page and are shown, with any tax, before you pay.
  • Premium starts with a 7-day free trial. A payment method is required to start it. Unless you cancel before the trial ends, your plan starts and you are charged automatically. We email you a reminder before the trial ends.
  • Subscriptions renew automatically at the end of each billing period until you cancel. If we change the price, we'll tell you in advance and the new price applies from your next renewal.
  • You can cancel at any time from your account, in two steps, under Manage subscription. You keep Premium until the end of the period you've paid for. After that, you can still read and play what was already created for you, but nothing new is generated. Where we offer it, you can pause instead of cancelling; while paused, nothing is charged and nothing new is generated.
  • Your monthly song starts with your first payment. An unused monthly song doesn't carry over to the next month.
  • The coach is part of Premium. Your free week includes 25 coach messages. Once you've paid, the coach has a fair-use limit of 50 messages a day and 1,000 in any 30 days.

5. One-time purchases

While you're a Premium member you can buy song bundles (1, 3 or 5 songs). They're one-time purchases, not subscriptions. They never expire and are used after your monthly allowance, while you're a member. Prices are shown, with any tax, before you pay. Paddle is the merchant of record, as for subscriptions.

6. Refunds

We offer a 14-day money-back guarantee on your first paid charge. Details are in our refund policy. Nothing in these terms limits your rights under consumer law.

7. Your content

You own what you write and record in Utopia, including your answers, journal entries and voice notes. You give us permission to store and process it only to run Utopia for you, as described in our privacy policy. The manifestos and other content Utopia creates for you are yours to use for your own personal purposes. Songs Utopia makes for you are for your own personal use; you may share them with people you know, but not sell them or use them commercially. They're made with AI, and we can't promise they're unlike any other music. When you share a card from Utopia, you choose what's on it; please share only what you're happy for others to see.

8. Fair use and acceptable use

Some features have fair-use limits, for example daily coach messages, so that Utopia stays fast and affordable for everyone. You agree not to:

  • break the law or use Utopia to harm, harass or deceive anyone;
  • upload content you don't have the right to use, or another person's voice or likeness without their consent;
  • try to get around limits or security, scrape the service, or use it to build a competing product;
  • use Utopia to generate content about or addressed to children, other than naming people you love within your own manifesto, or a song you make for your own child;
  • ask for songs that imitate a real artist, or use lyrics you don't have the right to use.

We may suspend or close an account that breaks these rules, and will tell you why unless the law or safety prevents it.

Own voice is only for your own voice. You confirm that the recordings are of you, and you may not record or upload anyone else's voice.

9. Our service

We work to keep Utopia available and secure, but we can't promise it will always be uninterrupted or error-free. We may change or improve features over time. Features described as "coming soon" are plans, not promises, and have no fixed release date.

Some creators recommend Utopia through personal links and may earn a commission if you become a member. This doesn't change your price or your membership.

10. Intellectual property

Apart from your content, Utopia, including its software, design, voices and written material, belongs to us or our licensors. You may use it only as these terms allow.

11. Liability

To the extent the law allows, we aren't liable for indirect or consequential losses, or for decisions you make based on content generated in Utopia, and our total liability to you is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms excludes liability that can't be excluded by law, or your statutory rights as a consumer.

12. Ending the agreement

You can stop using Utopia and delete your account at any time from settings. Deleting your account permanently deletes your data, as described in our privacy policy.

13. Complaints

If you're unhappy, email hello@myutopia.app with "Complaint" in the subject. We acknowledge complaints within 2 business days and aim to resolve them within 14 days. If you're in South Africa and we can't resolve your complaint, you can contact the Consumer Goods and Services Ombud (CGSO). Wherever you live, you can also use the dispute options available under your local consumer law.

14. Changes to these terms

We may update these terms. If a change matters, we'll tell you by email or in the app before it takes effect. The date at the top shows the latest version.

15. Governing law

These terms are governed by the laws of South Africa. If you live elsewhere, you keep the protection of the mandatory consumer laws of your country.
